Change name on property

I was married in Sept 2011 and need to change my name on my property title for tax purposes. Everything else is remaining the same on the title. I bought the house with my then boyfriend- now husband.

I spoke to an attorney and he quoted me around $150 for the change and an additional $30 fee to file it.

Is there another way to do this? I am a Wisconsin resident.

I'm from IL, and as far as I know, the deed will be in my maiden name until I sell it, because the name on the deed cannot be changed.

All I did was give the bank my new info for my accounts.

And this is where I'm confused. I keep reading that I do not have to change my name on the deed but what about filing my property tax on my tax return? The information came with my maiden name.

Maybe I should contact my bank about the property tax?

The bank does not have the authority to make any changes to your property tax invoice...I would contact your assessment authority, be it the regional district or city that you reside in.

As far as the deed goes, if indeed, you can change the title...doooo eeeet. One never knows when a clear line of ownership is necessary. Otherwise, have evidence handy showing your maiden name, your certified true copy of your marriage certificate and then, the subsequent name change.

(When I was widowed, name changes were not in place and things were complicated for a while)

Same for me.  They said it wasn't a problem to leave the title in my maiden name.  Since we're married and my ss# is the same... it's still 1/2 his house.

Well if I don't have to I wont because we are looking to sell the house this Aug and I'd rather we put the $150 back in to fix ups.

When we do our tax returns don't I have to list what we paid in property tax and send a copy of the form in to the IRS? That is where I'm worried the name will get rejected.

Doesn't matter.  Your social security number is the same.

Don't know about your state, but here in California, the names on the deeds can definitely be changed, although it is a bit of a process.  You may want to consider, although you look to still be young, creating a living trust and putting the property into the trust.

If all you need to do is change your name on your property tax statement, you should be able to take a copy of your marriage certificate to the County Assessor's office and get it changed.  It doesn't sound to me like you need a deed for the change you want to make, but I could be misunderstanding you or your state may have a specific way of doing things.

i do not know what county you are in but Winnebago has instructions on line and even has the Quit Claim document on line that you need to record.  link is below.  Wen you sell the house you will need to have the vesting as it appeared on the purchase document and the Escrow co/Lawyer can help you then.  Most laws in a state are the same, some counties have a few of their own.  If you go to/call the recorders office and ask they can help you.

I found the Quit Claim Form a few months ago but when I tried speaking to the title company and the recorder's office they both told me they couldn't help and to contact an attorney. I asked if I "needed" an attorney to file and they said "No, but we can't help you file it alone". WTH??

That's their nice way of telling you they won't give you any legal advice.

Seriously, something like a deed to a piece of property has huge significance beyond what you might be intending.  Spend the $ to talk through the lawyer and make sure you're doing what you intend and doing it right.  Consider the source, of course.  ;-)

I really don't mind if the deed is in my maiden name. I guess we will change it later this summer if needed when we (hopefully) sell the house.

I get all confused with taxes.

They aren't offering you advice on a quit claim deed because it's a rather wooly bit of business.

You see a lot of fraud occurs there due to the nature of it: grantor doesn't even need to own the property to "transfer" it to a grantee so the grantee has no rights to recovery if they are subject to fraud. Caveat Emptor, hence they've probably been instructed to NOT offer any assistance with such transactions.

That being said, since your are both the grantor and the grantee, it sounds like a good fit for you.

When I divorced I got the house.  I changed my name back to my maiden name.  I contacted title company and paid about $60 to change the name.
